This is measured in terms of BAC, or blood alcohol content. If your BAC is between .04 and .079, the police officer has the discretion to decide whether you are too impaired to be driving. If your BAC is at least .08, you will be presumed intoxicated. A standard or per se DUI will be issued when the driver’s BAC is between .08 and .149. The next level of DUI is Extreme DUI, which is issued when the driver’s BAC is between .15 and .19. If the driver has BAC of .20 or higher, they will be charged with Super Extreme DUI.

Felony DUI Convictions in AZ
All the DUI convictions described above are misdemeanors, but you can also be charged with a felony DUI under certain conditions. This is also known as an Aggravated DUI. The aggravating factors that turn a misdemeanor DUI into a felony DUI are:
  • There is a passenger under 15 years of age in the car when the driver is arrested; 
  • This is the driver’s 3rd DUI conviction in 7 years;
  • The driver currently has an ignition interlock device (IID) installed in their vehicle; or
  • The driver is driving on a suspended or revoked driver’s license.

There are other hidden penalties that come with an Arizona DUI conviction. First, you may need to pay to install your IID into your vehicle, and you will need to pay a monthly fee for it as well. You will also need to maintain high-risk auto insurance, which will cost at least twice as much as you currently pay for car insurance. You will need to complete community service, which is generally at least 30 hours. Furthermore, you may also need to pay reparations to anyone you injured or whose property you damaged.

The other hidden cost of a DUI conviction is that it will remain on your record for life. That means that in all future job applications, apartment rental background checks, and similar situations will have full view of your DUI conviction, and possibly hold that against you.
